Privacy Policy
Dynamic Muscle and Fitness Centre

Effective Date: 01/01/2026

Dynamic Muscle and Fitness Centre is committed to protecting the privacy of members, casual visitors, website users, and other individuals who interact with our business. This Privacy Policy explains how personal information is collected, held, used, disclosed, and otherwise handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs").[oaic.gov]

By using our website, attending our facility, joining as a member, submitting forms, or otherwise providing personal information to us, you acknowledge that your information will be handled in accordance with this Privacy Policy.[business.gov]

Information Collected

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and regardless of the form in which it is recorded. This can include details such as a person’s name, contact details, date of birth, medical records, bank details, photos, videos, and IP address.[business.gov]

The types of personal information collected may include:

  • Full name, date of birth, gender, address, phone number, and email address.[business.gov]
  • Emergency contact details and next of kin information.[oaic.gov]
  • Membership records, attendance history, booking history, service usage, and account login activity.[business.gov]
  • Payment, billing, transaction, and account-related details.[business.gov]
  • Health and fitness information relevant to service delivery, including injury history, medical conditions, exercise limitations, PAR-Q responses, and other health-related details voluntarily provided by you. Sensitive information is subject to higher collection standards under the APPs.[tkodocs]
  • Website and device information, including IP address, browser type, pages accessed, date and time of visit, and similar technical usage data collected through website systems and cookies.[wgea.gov]

Collection Methods

Personal information may be collected directly from you when you:

  • apply for or renew a membership;
  • complete pre-exercise screening forms, waiver forms, consultation forms, or other intake documents;
  • make an enquiry in person, by phone, by email, through social media, or via our website;
  • make bookings for classes, coaching, consultations, or other services;
  • make payments or update payment details;
  • log in to any member portal, mobile app, or online account linked to our services; or
  • use our website or digital systems.[homeaffairs.gov]

Information may also be collected from third parties where reasonably necessary, such as payment providers, software platforms, authorised representatives, or where you ask another person to deal with us on your behalf.[oaic.gov]

Purpose of Collection

Personal information is collected where reasonably necessary for our functions and activities. Under the APP framework, personal information is generally to be used or disclosed for the primary purpose for which it was collected, unless consent is given or another legal basis applies.[oaic.gov]

Personal information may be collected, held, used, and disclosed for purposes including:

  • establishing and administering memberships and visitor access;
  • providing gym access, coaching, exercise programming, and related services;
  • assessing health, safety, readiness for exercise, and service suitability;
  • managing bookings, attendance, scheduling, and customer support;
  • processing payments, renewals, failed payments, refunds, and account administration;
  • communicating operational notices, service updates, changes to hours, safety matters, and account-related messages;
  • sending marketing or promotional communications where permitted by law or with consent;
  • improving our services, systems, website performance, and customer experience;
  • maintaining internal records and meeting insurance, legal, regulatory, and risk management obligations.[oaic.gov]

Sensitive Information

Some information collected by a gym may constitute sensitive information, including health information. The APPs apply higher standards to the collection of sensitive information.[oaic.gov]

Where health or other sensitive information is collected, it will only be collected where reasonably necessary for our services, safety obligations, or related business functions, and where required, with your consent or as otherwise permitted by law.[tkodocs]

If you choose not to provide requested health or personal information, we may be limited in our ability to assess suitability for training, provide tailored services, allow participation in certain activities, or maintain a safe exercise environment.[oaic.gov]

Website Data and Cookies

When you use our website, certain information may be collected automatically for operational, analytical, and security purposes. This may include your IP address, device or browser information, pages viewed, access times, referring website, and similar browsing data.[wgea.gov]

Our website may use cookies and similar technologies to improve website functionality, remember preferences, analyse traffic, and support marketing or remarketing activity. You may be able to disable cookies through your browser settings, although doing so may affect website performance or functionality.[pwc.com]

Disclosure

Personal information may be disclosed to third parties where reasonably necessary for the purposes described in this Privacy Policy, including to:

  • payment processors and direct debit providers;
  • software providers, CRM systems, booking platforms, and website service providers;
  • coaches, staff, contractors, and service providers who require access to perform their duties;
  • accountants, legal advisers, insurers, and professional advisers;
  • government bodies, regulators, law enforcement agencies, or courts where required or authorised by law.[oaic.gov]

Personal information should not be used or disclosed for a secondary purpose unless consent has been obtained or another exception under privacy law applies.[oaic.gov]

We do not sell personal information to third parties.[oaic.gov]

Marketing

Personal information may be used to send marketing, promotions, special offers, or updates about services where permitted under applicable law or where consent has been provided. The APPs allow direct marketing only in certain circumstances.[oaic.gov]

You may opt out of receiving marketing communications at any time by using the unsubscribe function in the message or by contacting us directly. Operational or account-related communications may still be sent where necessary.[oaic.gov]

Overseas Disclosure

Some third-party service providers used in connection with website hosting, cloud storage, CRM systems, email delivery, analytics, or payment processing may store or process personal information outside Australia. APP 8 addresses steps that must be taken before personal information is disclosed overseas.[oaic.gov]

Where overseas disclosure occurs, reasonable steps will be taken to ensure that overseas recipients handle personal information in a manner consistent with applicable privacy obligations, unless an exception under law applies.[oaic.gov]

Security

Reasonable steps are taken to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These protections may include password controls, restricted staff access, secure software systems, procedural safeguards, and other security measures appropriate to the nature of the information held.[business.gov]

No method of data transmission over the internet or electronic storage is completely secure. While reasonable safeguards are used, absolute security cannot be guaranteed.[business.gov]

Retention

Reasonable steps will be taken to destroy or de-identify personal information when it is no longer needed for any permitted purpose, subject to legal, accounting, insurance, dispute, or record-keeping requirements. APP 11 includes obligations to destroy or de-identify personal information in certain circumstances.[business.gov]

Access and Correction

You may request access to personal information held about you, subject to any exceptions permitted by law. APP 12 sets out obligations relating to access requests, and APP 13 addresses correction of personal information.[oaic.gov]

If you believe that personal information held about you is inaccurate, incomplete, out-of-date, irrelevant, or misleading, you may request that it be corrected. Reasonable steps will be taken to update or correct information where appropriate.[oaic.gov]

Requests for access or correction should be made using the contact details below. We may require identity verification before processing a request.[oaic.gov]

Anonymity

APP 2 provides that individuals should generally have the option of not identifying themselves, or of using a pseudonym, in certain dealings with an APP entity where lawful and practicable. In many cases, however, it is not practical for a gym to provide membership, bookings, health screening, payments, safety monitoring, or facility access on an anonymous basis.[oaic.gov]

Complaints

If you believe that personal information has been handled in a way that breaches applicable privacy law, a complaint may be made in writing using the contact details below. Complaints will be reviewed and responded to within a reasonable period.[fitness.org]

If the response is not satisfactory, you may be able to lodge a complaint with the Office of the Australian Information Commissioner.[business.gov]

Data Breaches

If a data breach involving personal information is likely to result in serious harm, obligations may arise under the Notifiable Data Breaches scheme to notify affected individuals and the Office of the Australian Information Commissioner.[business.gov]

Changes

This Privacy Policy may be updated from time to time to reflect changes in legal requirements, business practices, systems, or services. The current version will be published on our website.[business.gov]
